What we have here is truly manipulative. Four justices create a right, and then a sympathetic attorney general renames a proposition so as to protect a 4-month-old right that no one had ever voted to create.
And the left accuses the right of imposing its values on society.

As I noted in my post on this subject – see Proposition 8 – The Best Gift Video – what Attorney General Brown did was pure Hegelian dialetic!

Dave,
In reality, no “right” was created. Courts will base their decisions on constitution and precedent. For myself, it’s a matter of 14th amendment rights, equal protection. For instance in the 1940’s the California Supreme Court struck down laws banning interracial marriage, even though most Californians at the time supported such a ban. In 1967 the US Supreme Court, struck down the rest of the anti-miscegenation laws. In the mid-60’s in California the John Birch Society and the State Assembly Republicans launched an initiative drive that would allow landlords to discriminate. the number of signatures was well over a million and the measure itself passed 65%-35%. 3 years later the law was overturned by the Us Supreme court as it violated existing law, namely the 14th amendment. The “created rights” rhetoric is total crap, designed to inflame the emotions of those less prone to actually thinking about what’s really going on. Obviously I am not one of THOSE people.BTW, the 14th Amendment is the main reason why anti-abortion laws will never be fully implemented. Any such law that affects let’s say the doctor, has to apply equally to the mother. Perp walks of abortion doctors and moms (with their children crying in the background) doesn’t make for good publicity.
